Agreement for Repair
1.1 The terms set out in these Conditions of Repair (“Agreement”) shall apply to the service (“Service”) we provide to repair your smartphone, tablet, computer and/or any accessories (“Device”) on the service check-in form.
1.2 Reference to “us”, “we” and “our” refer to UniverCell and references to “you” and “your” are references to you (“Customer”), the person addressed on this form.
2.1 This Agreement shall commence from the date you book a repair and shall continue until we have repaired or otherwise returned your Device, whichever is sooner, and received any payment due from you.
2.2 We shall make reasonable efforts to repair your Device subject to the availability of any parts required and/or the terms of any relevant guarantee or warranty. We shall perform the Service using our utmost care and skill.
2.3 We shall use Genuine, OEM, or High-Quality compatible parts for the repairs of all Devices.
2.4 We shall require the passcode of your Device in order to test the Device before and after the Service. Should you prefer to keep this information private, we can still proceed with an appointment, but will not be able to perform a full functional check on the Device until you return to the store, which can delay the provision of the Service, if any adjustments need to be made.
2.5 Any time estimate for completion of the service, which may be given to you, is an estimate only and does not form any obligation under the terms of this Agreement. We will aim to return your Device as soon as reasonably possible, however, any Board Level (Level 3) repairs (i.e. repairs to the logic board of the Device) may take at least 5 working days to be completed.
2.6 We shall notify you when the Device has been repaired. If necessary, we shall send a reminder and the device will be recycled if not collected by day 90 to cover our costs.
2.7 If we are unable to complete the Service for any reason, or the Service will incur further costs payable by you beyond that initially estimated by us, we will notify you immediately via telephone and/or email. If no fault is found on your Device or you do not accept our revised estimate, we will return your Device to you unrepaired and we reserve the right to charge you an inspection fee in accordance with our standard charges.
2.8 The cost of repair will be calculated where possible in accordance with our standard charges as published from time to time.
2.9 We shall be entitled to keep your Device until all charges payable have been paid. We may also charge an additional fee for storage of your Device.
2.10 Use of our service may void your manufacturer’s warranty. If you would like to avoid this, then please take your Device directly to the manufacturer. Please note, your manufacturer’s warranty will not cover any accidental damage.
2.11 UniverCell may install warranty seals following the repair. Any tampering of the seals will void our warranty.
2.12 Our products and repairs are covered by the warranty terms outlined in the table below:

2.13 The Warranty is linked to a specific device as identified by its unique IMEI or serial number and to a specific Customer as identified by the records on our system. It will cover the Customer for any re-occurrence of the original fault and for the part replaced / repaired only, however if additional faults arise, they will not be covered under the terms of this Warranty. Furthermore, the Warranty will not cover accidental damage, nor will the cover extend should the device change ownership.
2.14 We do not accept responsibility for any progression in damage where your Device has been repaired elsewhere prior to your repair at the UniverCell or any issues found in your Device (i.e. ‘Touch Disease’, ripped flex) which were not evident upon initial inspection. Should any issues become evident, once the Device is opened, we will contact you via telephone/email.
2.15 We do not accept responsibility for any progression in damage for Devices that have been damaged by liquid. Opening the Device could set off further damage which in some cases may be very serious and irreparable.
2.16 We ask our Customers to monitor their Device post liquid damage repair, as unknown issues can arise soon after treatment for liquid damage, which are beyond our control.
2.17 We do not offer warranty for liquid damage repairs. Should your Device display any further issues relating to the liquid damage during the Warranty period, we will re-assess and re-quote for the work needed.
2.18 Following repair, any water proofing or resistance cannot be guaranteed.
Liability
3.1 Our entire liability in respect of any single cause of action arising out of or in connection with this Agreement (whether for breach of contract, tort, including negligence, statute or otherwise at all) shall be limited, to the extent that the cause of action related to our supply of the Services, at our exclusive option to: (a) supplying the Services again; (b) payment of the cost of having the Services supplied again; or (c) repaying you any amount that you have paid in respect of the Services.
3.2 If your Device is damaged beyond economical repair as a direct result of a service or repair undertaken by us, you are entitled to a fully functional refurbished device of equal value to your Device, based on its model and condition as received and with the original repair issue resolved. In order to receive a replacement device, full payment must have been received for the repair service and the relevant damaged device must be surrendered to us.
3.3 Any data or information that you may have stored on the Device shall remain your sole responsibility and we accept no liability for loss or corruption of such data however caused and we therefore highly recommend that you back up your Device onto an external drive prior to commissioning our Service. It is your responsibility to keep a record of any such data.
3.4 Nothing in this clause 3 shall apply so as to limit or exclude our liability for: (a) death or personal injury resulting from our negligence; (b) breach of any terms implied by statute; (c) any claim arising under the Consumer Protection Act 1987; or (d) fraudulent misrepresentation.
3.5 In no circumstance shall we be liable to you for any indirect, special or consequential loss arising out of or in connection with this Agreement, including any loss of business, revenue, profits, anticipated saving, goodwill or any other indirect or consequential loss or damage of whatsoever nature howsoever arising.
3.6 We shall not be liable for any claim arising under this Agreement unless you give us written notice of the claim within three months of becoming aware of the circumstances giving rise to the claim or, if earlier, three months from the time you ought reasonably to have become aware of such circumstances.
3.7 If you opt for a board level repair, be aware we will be working on the component level of your logic board therefore, we can’t guarantee a fix on the device or data protection. Due to the nature of the repair there is always a possibility that the damage may worsen to the stage where the device is BER (beyond economical repair). In these circumstances, we will refund all payments for this repair. We offer a 1-month warranty on board-level repairs.
Data Protection
4.1 We ask for your name and address and the other details so that we can notify you when your Device has been repaired and provide you with an efficient after-sales service. We may also send you text messages and/or emails from time to time to alert you to new services and promotions. By signing the T&C and using these Services you consent to our use of your personal information as described.
General
5.1 We shall not be liable to you for any delay in our failure of performance of our obligations under this Agreement arising from any reason beyond our reasonable control.
5.2 Our failure to exercise or enforce our rights or the giving of any forbearance, delay or indulgence, will not be construed as a waiver of such rights under this Agreement or otherwise.
5.3 This Agreement sets out the entire agreement and understanding between you and us in connection with its subject matter.
5.4 This Agreement may not be amended, modified, varied or supplemented except in writing signed by or on behalf of you and us.
5.5 If any part of this Agreement is found to be void or unenforceable it will be severed from the rest of the Agreement so that it is effective to the extent that it shall not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms.
5.6 Nothing in this Agreement shall confer on any third party and benefits under the provisions of the Contracts (Rights of Thirds Parties) Act 1999.
5.7 This Agreement shall be governed by the laws of Canada and shall be subject to the exclusive jurisdiction of the Canadian Courts.
Device Buyback Terms and Conditions
1. Overview
These Terms and Conditions (“Terms”) constitute a legally binding agreement between UniverCell Canada (“we,” “us,” “our”) and individuals or entities (“you,” “seller,” “user”) who access or use our website (UniverCell Canada) or related services to sell electronic devices through our Buyback Program. By using our services, you acknowledge that you have read, understood, and agreed to these Terms.
These Terms must be read in conjunction with our Privacy Policy and any other guidelines or policies displayed on our website.
2. Services Provided
UniverCell Canada’s Buyback Program offers the opportunity to sell used electronics, including smartphones, laptops, tablets, and gaming consoles, through a straightforward process that includes:

3. Device Condition and Grading
3.1. Honest Representation: Sellers must provide accurate and truthful information regarding device conditions during the quoting process.
3.2. Inspection and Grading: The device value is based on the condition determined during our inspection, which may differ from your online assessment.
3.3. Device Categories:
- Functional Devices: Devices that power on and pass all functional tests.
- Non-Functional Devices: Damaged or non-operational items are valued accordingly.
3.4. Devices with incorrect descriptions may result in adjusted offers or rejection.
4. Data Security
4.1. Seller’s Responsibility: Sellers must factory reset or completely wipe all personal data from devices prior to sale.
4.2. Data Erasure Assistance: If required, UniverCell Canada staff may assist with data erasure. However, we assume no liability for data loss or device issues arising during this process.
4.3. Privacy Compliance: Once sold, devices are subjected to a factory data reset to eliminate any residual data, ensuring privacy and security.
5. Payment and Ownership Transfer
5.1. Payments will be issued after a thorough inspection and acceptance of the device.
5.2. Ownership of the device is transferred to UniverCell Canada upon receipt of payment.
5.3. Payments may take up to 3 business days to process and are made via the agreed method (e.g., cash, e-transfer, store credit).
6. Prohibited Devices
We do not accept devices that are:
- Blacklisted, stolen, or flagged for fraudulent activity.
- Carrier-locked without disclosure or authorization for transfer.
- Devices with activation locks or Mobile Device Management (MDM) restrictions that cannot be bypassed.
Such devices will be rejected or returned at the seller’s expense.
7. Shipping and Drop-Off Policy
7.1. Shipping Requirements:
- Sellers must securely package devices to avoid damage during transit.
- Devices must be factory reset before shipping. If not, UniverCell Canada will reset the device upon receipt.
7.2. Drop-Off Guidelines:
- Devices should be prepared with all personal data erased.
- Data erasure assistance is available but at the seller’s risk for data loss or device damage.
7.3. Responsibility for Damages: UniverCell Canada is not liable for damages resulting from inadequate packaging or transit.
8. Device Purchase Refusal Policy
At UniverCell Canada, we uphold a strict policy regarding the acceptance of devices for our buyback program. We reserve the right to decline any device under the following conditions:
8.1. Device Eligibility
- Locked or Restricted Devices:
- Devices that are reported as lost, stolen, blacklisted, or restricted in any way, such as being locked to a specific carrier or linked to a user account (e.g., iCloud).
- Only devices with verifiable legal ownership will be considered for purchase.
- Recently Purchased Items:
- Smartphones acquired within the past six months without proof of purchase will not be eligible.
- Devices at Risk:
- Devices flagged as potentially high risk for becoming blacklisted in the future.
- Severely Damaged Devices:
- Devices with significant physical or functional damage that impairs usability. Such as board-level issues, significant frame damages, etc.
- Outstanding Financing:
- Devices still tied to an active payment plan with providers such as Bell, Freedom, or Virgin are ineligible.
- Battery Health Issues:
- Laptops or watches with alerts indicating “Battery Service Recommended” will not be accepted.
8.2. Unacceptable Conduct
- Disrespectful Behavior:
- Any inappropriate, aggressive, or disrespectful interactions directed toward our representatives, whether through in-store visits, phone calls, emails, or live chat sessions, may result in refusal to conduct further transactions.
- At UniverCell Canada, we strive to maintain a professional and respectful environment for both our team and customers. Any actions that disrupt this commitment will not be tolerated.
9. Unresponsive Sellers
If a seller fails to respond to requests for additional information or device condition verification within 30 days, the device will be recycled without compensation.
10. Limitation of Liability
UniverCell Canada is not responsible for:
- Loss, theft, or data breach due to the seller’s failure to perform a factory reset.
- Damages or loss during shipping, inspection, or testing.
- Indirect, incidental, or consequential damages arising from participation in the Buyback Program.
Your use of this service is at your own risk and is provided “as is” without warranties of any kind.
11. Changes to Terms and Conditions
UniverCell Canada reserves the right to amend these Terms at any time. Updated Terms will be effective immediately upon posting on our website. Continued use of our services signifies acceptance of the changes.
Additional Information
Registration of a UniverCell user account is not mandatory for accessing our services or browsing our website. However, to utilize our provided services for completing transactions, it is necessary.
During registration, you will be required to provide details such as your name, phone number, email address, physical address, and any other pertinent information as requested. By registering, you agree to provide accurate and truthful information, updating it as necessary.
You affirm that you are at least 18 years old to engage in our services, as we do not engage in contracts with minors. If your return is approved, we will initiate a refund to your original method of payment. You will receive the credit within a certain amount of days, depending on your card issuer’s policies.
